Terms for website access, inquiries, demonstrations, and other pre-contract interactions with Kathisma.
Interim website terms. These terms intentionally do not invent a corporate entity. The exact contracting legal party must be identified in each activated paid-service or referral agreement.
1. Scope of these terms
These Website Terms apply to use of KathismaAI.com and the Kathisma Travel, Kathisma CRE, and Kathisma Residential website experiences (collectively, “Kathisma”). They govern website access, inquiries, demonstrations, and other pre-contract interactions. They do not replace a signed proposal, order form, pilot agreement, statement of work, referral agreement, or other paid-service contract. Where a separate written agreement applies, that agreement controls for the applicable service.
2. No paid engagement created by website use
Submitting an inquiry, partner application, planning request, or other website form does not by itself create a consulting, travel-planning, referral, brokerage, agency, fiduciary, or other paid-service relationship. A paid engagement begins only when the applicable commercial terms are accepted through the process Kathisma specifies. The legal contracting party for a paid engagement will be identified in the applicable proposal, order, payment or service documentation.
3. Kathisma Travel
Kathisma Travel is positioned as a human-reviewed travel-planning experience. Unless a specific written arrangement expressly states otherwise, Kathisma does not represent itself as a travel agency, tour operator, airline, hotel, transportation provider, or merchant of record for third-party travel inventory. Recommendations, routes, schedules, availability, prices, entry requirements, and other travel information can change. Travellers remain responsible for verifying time-sensitive information and for the terms of bookings or purchases they make with third-party providers.
4. Kathisma CRE
Kathisma CRE is an asset-plan execution and operating-intelligence layer intended to work above or alongside a customer's existing systems and management processes. Website content, synthetic examples, demonstrations, or product outputs are not investment, legal, accounting, valuation, engineering, tax, or other regulated professional advice and do not guarantee financial results, value realization, security outcomes, or management decisions.
5. Kathisma Residential
Kathisma Residential is a transaction-assurance and human-review support layer intended to work above or alongside existing brokerage and transaction systems. It does not provide legal advice, replace the responsibilities of a brokerage, Broker of Record, registrant, lawyer, or other professional, or guarantee regulatory compliance, closing outcomes, document sufficiency, or the absence of transaction risk. Human review and professional judgment remain required.
6. Synthetic and illustrative material
Kathisma may use fictional, synthetic, simplified, or illustrative scenarios to demonstrate workflows and product concepts. Such material is not a representation that a named or real customer achieved the illustrated result and should not be treated as customer evidence, a performance guarantee, or a statement of typical results unless Kathisma expressly identifies verified evidence as such.
7. Website information and availability
Kathisma aims to keep website information useful and current but does not warrant that every page, demonstration, third-party data point, schedule, price, product description, or external link will always be complete, current, error-free, or continuously available. Commercial pricing and scope are governed by the specific offer or agreement presented for the transaction, not by stale or cached website content.
8. Acceptable use
You may not use the websites to interfere with service operation or security; attempt unauthorized access; introduce malicious code; scrape or harvest personal information in violation of law; impersonate another person; submit information you are not authorized to provide; misuse demonstrations or non-public materials; or use Kathisma intellectual property in a misleading, unlawful, or unauthorized manner.
9. Intellectual property
The websites, product names, software, interfaces, demonstrations, text, graphics, workflow designs, and other Kathisma materials are owned by or licensed to Kathisma and are protected by applicable intellectual-property laws. Website access does not transfer ownership or grant a right to copy, commercialize, reverse engineer, publish, distribute, or create derivative commercial materials except as expressly permitted in writing or allowed by law.
10. Third-party services
Kathisma may link to or interoperate with third-party websites, data sources, payment processors, travel suppliers, software platforms, or other services. Those third parties operate under their own terms and privacy practices. Kathisma is not responsible for a third party's services, content, availability, pricing, performance, security, or contractual obligations merely because Kathisma references or links to them.
11. Privacy
Information submitted through the websites is handled in accordance with the Kathisma Privacy Notice and any more specific written agreement that applies to a paid service or pilot. Do not submit confidential or regulated third-party data through ordinary inquiry forms unless Kathisma has requested it and an appropriate data-handling basis is in place.
12. Disclaimers
To the maximum extent permitted by applicable law, the public websites and free demonstrations are provided on an “as is” and “as available” basis without warranties of uninterrupted availability, fitness for a particular purpose, non-infringement, or guaranteed outcomes. Nothing in these Website Terms excludes warranties or rights that cannot lawfully be excluded. Paid-service warranties, if any, are governed by the applicable written customer agreement.
13. Limitation for website use
To the maximum extent permitted by applicable law, Kathisma will not be liable for indirect, incidental, special, punitive, or consequential loss arising solely from use of, or inability to use, the public website or a free demonstration. Any liability arising from a paid engagement is governed by the applicable customer agreement. Nothing in these terms limits liability that cannot legally be limited.
14. Governing law
These Website Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules, subject to any mandatory consumer or other rights that apply in another jurisdiction. Disputes concerning only these Website Terms are subject to the courts of Ontario unless applicable law requires otherwise.
15. Changes
Kathisma may update these Website Terms as the websites, services, and legal requirements evolve. The version posted when you use the website applies to that website use, while a separately executed customer or partner agreement remains governed by its own amendment provisions.
